2. Definitions

“We/Us/Our” means Trans4 Ltd, trading as MotoWales and Fu3l Tank.
“You/Your” means the customer, trainee, or tour participant.
“Goods” means the motorcycle parts, accessories, apparel, or any other items purchased from us.
“Services” means installation/fitting, training, tours, and related offerings.
“Installation Service” means fitting products to a customer’s motorcycle.
“Training” means any riding or safety instruction service.
“Tour” means any organised ride or event offered by us.
“Order” means your purchase order made online, in-store, or via phone/email.
“Consumer” means an individual purchasing for personal use and not for business purposes.

3. Application of Terms

3.1 These Terms apply to all Orders for Goods or Services.
3.2 By placing an Order, you agree to these Terms.
3.3 Any variation must be confirmed in writing by us.
3.4 An Order is accepted when we confirm by email, issue an invoice, or dispatch the Goods.

4. Prices and Payment

4.1 Prices include VAT (where applicable).
4.2 We reserve the right to change prices before accepting your order.
4.3 Goods remain the property of Trans4 Ltd until full payment is received.
4.4 Payment must be made using one of the methods shown on our website or invoice.
4.5 Deposits or full payments for installations, training, or tours must be received in advance as stated at booking.

5. Delivery of Goods

5.1 Delivery times are estimates only. We are not liable for delays beyond our control.
5.2 Risk transfers to you upon delivery or collection.
5.3 Title transfers to you only when full payment is received.
5.4 You must inspect items upon delivery and report any damage or missing parts within 48 hours.

6. Installation Services

6.1 Installation is performed with reasonable skill and care.
6.2 You must ensure your motorcycle is insured, roadworthy, and safe for work.
6.3 We are not responsible for damage arising from previous modifications or misuse.
6.4 If you fail to present your motorcycle on the agreed date, a rescheduling or cancellation fee may apply.
6.5 Any post-installation adjustments requested outside warranty may incur additional costs.

7. Training Services

7.1 You participate in any training entirely at your own risk.
7.2 You must hold a valid licence, adequate insurance, and wear appropriate safety gear.
7.3 Our instructors may terminate a session if a rider is unfit, unsafe, or under the influence of alcohol/drugs.
7.4 Training may be rescheduled due to weather or safety concerns.
7.5 We accept no liability for personal injury, loss, or damage except where caused by our negligence.

8. Tours and Events

8.1 A non-refundable deposit is required to secure your place on any tour or event.
8.2 Remaining balances must be paid by the specified due date.
8.3 You must hold your own motorcycle insurance, road-legal licence, and protective gear.
8.4 Participation is entirely at your own risk.
8.5 We may cancel or alter tours for safety or logistical reasons. In such cases, we will offer an alternative date or partial refund (excluding non-recoverable costs).
8.6 We are not liable for injury, loss, theft, or property damage except where caused by our negligence.

9. Returns, Refunds and Cancellations

9.1 Statutory Right to Cancel

As a consumer, you have the legal right to cancel your purchase within 14 calendar days of receiving your Goods.
To exercise this right, you must notify us in writing within 14 days and return the Goods within another 14 days.

9.2 30-Day Goodwill Return Policy

In addition to your statutory rights, we offer a 30-day money-back guarantee as a gesture of goodwill.

Goods returned after 14 days but within 30 days will be accepted at our discretion, provided they are:
- Unused
- Uninstalled / not fitted to a motorcycle
- Unopened and unsealed
- In their original packaging with all parts, accessories, and manuals included
Returns after 30 days will not be accepted.
Return shipping is at your cost unless the item is faulty or incorrectly supplied.
The Goods remain your responsibility until we receive them.

9.3 Refunds

Refunds will be issued within 7 working days of receiving the returned item in acceptable condition, using the original payment method.

9.4 Exclusions

We cannot refund or exchange items that have been opened, fitted, or used.
Bespoke, personalised, or special-order products are non-returnable unless defective.
Business customers do not qualify for this goodwill extension or cancellation right.

10. Warranty Claims

10.1 Goods are covered by the manufacturer’s warranty where applicable.
10.2 You must notify us of any defect as soon as possible and provide proof of purchase.
10.3 We will assist with warranty claims, but final approval rests with the manufacturer.
10.4 Warranty does not cover misuse, incorrect fitting (unless installed by us), wear and tear, or damage caused by third-party modification.
10.5 Our liability is limited to replacement, repair, or refund at our discretion.

11. Limitation of Liability

11.1 We are not liable for indirect or consequential losses, including loss of profit or downtime.
11.2 Our total liability for any claim will not exceed the price paid for the Goods or Services.
11.3 Nothing in these Terms limits your statutory rights under UK law.

12. Data Protection and Privacy

12.1 We process personal data in accordance with UK GDPR and our Privacy Policy (available on our website).
12.2 Your data will only be used for order fulfilment, communication, and legal compliance.

13. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our control, including weather, accidents, supplier issues, or industrial action.

14. Intellectual Property

All website content, logos, and designs remain the intellectual property of Trans4 Ltd and may not be reproduced without written permission.

15. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of England and Wales.
Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
